Notes for GEORGE HALE:
Goerge was a member of the House of Burgesses from Lancaster VA. When
George & Sarah Smith were married---he was 18, & she was 14. They had
both their parents permission to marry. Sarah was the daughter of Phillip
Smith & Mary Mathews, with her ancestry going back though the 'Warners,
Reades, Martians, Bernards, & Cordrays to Edward II, & Edward I of
England. WILL OF GEORGE
HALE/HEALE:::::::::::: In the name of God, Amen, I George Hele of the
county of Fauquier, being of sound memory do make & ordain this my last
will & testament in manner & form following, Viz. I bequeath my soul to
God my Creator & my body to the earth its orginal being assured that the
sacrifice of Christ is sufficient to atone for all the sins of the
faithful & therefore hope that my soul & body will have a joyful
meeting at the resurrection of the just through the merits, mediation, &
intercession of my complete Redeemer, the Lord Jesus.
I give to my son William all my lands near little River, viz. eleven
hundred & thirty acres I bought of Thomas Edwards, five hundred acres I
bougjt of Charles (Chinn/Chilton?), & two hundred acres I bought of Raw I
Sherman, the whole amounting to eighteen hundred & thirty acres be the
same more or less to him & his heirs forever. I likewise give to my son
William all the negroes, horses, cattle, hogs, & sheep & all their future
increase & all the plantation utensils that shall be on the aforesaid
land at my deceased to him & his heirs forever.
Item, I give all the lands I bought of the exec.s of Charles, Esq.,
deceased, containing fifteen hundred acres, also five hundred & nineteen
acres I bought of Col. Thomas Chilton, also two hundred & seventy acres I
bought of William Wyatt, who bought of the exec.s of Charles Carter,
Esq.,dec., also two hundred & ninety seven acres I bought of Joseph Basie
the whole amounting to two thousand five hundred & eighty six acres be
the same more or less, to be equally divided between my sons, Smith &
Joseph, to them & their Heirs forever.
Item, I give to my son Joseph the following negroes & their future
increase, viz. Solomon, Phil, Ralph, Billy, Alice, Sary, Molly, Little
Abraham, Anthony, Mary, George, Big Betty, Fanny, Letty, Rachel, Little
Nancy, Hannah, Jenny, Tillie, Charlotte, Dorcas, Easter, & my carpenter
Abel, to him & his heirs forever.
Item, I give to my son Smith my shoemaker Abraham & all the negroes &
stock of all kinds that shall be in his possession at my death to him &
his heirs forever.
Item, I give my beloved wife Sarah the use of the remainder of negroes on
the plantation whereon I now live & the Forrest plantation for & during
her natural life & at her decease, to go to my son Joseph together with
their fitire increase to him & his heirs forever.
Item, I give to my son Joseph five beds & furniture, also my desk, wagon,
& gear, & two thirds of my plantation utensils to him & his heirs forever.
Item, I give to my beloved wife Sarah, the use of the remainder of my
beds & furniture & curtains for & during her natural life & at her
decease to my son Joseph & his heirs forever.
Item, I give to my beloved wife Sarah the use of one third part of my
work horses, cattle, hogs, & sheep, & plantion utensils for &during her
natural life & at her decease to my son Joseph & his heirs forever.
Item, I give to my son Joseph two thirds of my work horses, two thirds of
my cattle, hogs, & sheep, also half of my household & kitchen furniture
not before mentioned, to him & his heirs forever.
Item, I give to my beloved wife Sarah, the use of the other half of my
household & kitchen furniture not mentioned, also the desk in the chamber
for & during her natural life & at her decease to my son Joseph & his
heirs forever.
Item, My will is that my beloved wife Sarah live where I do now during
her natural life & to have the use of four hundred acres of land.
Item, My will is that my lands divided to my sons, Smith & Joseph, shall
not be divided thus till after the death of my wife, Sarah.
Item, I give to each of my daughters, viz. Mary, Percilla, Sarah,
Mildred, Elizabeth, & Jane the sum of twenty shillings current money of
Virginia to be paid by my son Joseph in twelve months after my decease,
they & each of them having received their fortunes at their marriage.
Item, My willis that my son Joseph pay all my just & lawful debts & that
he have allthe crops that shall be on hand at my death & I also give to
my son Joesph everyting else that I have not mentioned of my estate to
him & his heirs forever.
Item, I give to my son Philip, twenty shillings current money of Virginia
to be paid him by my son Joseph in twelve months after my decease, he
having received his portion at his marriage.
Item, My will is that my estate be inventoried but not appraised. I do
hereby nominate & appoint my sons William, Smith, & Joseph executors of
this my last will & testament. In wittness whereof I have hereunto set my
hand & affixed my seal this 24th day od AUGUST,

Codicil::: A codicil to my will I do subjoin & intend to be taken as part
therof. Whereas since making my will, eight negries have become my
property by the death of Mrs. Mary Smith as sister of my wife, I do
hereby direct & desire that the said negries may be sold & the money laid
out immediately in other slaves & the said slaves placed in the hands of
William Bronough & Joseph Heale as trustees to employ them & the profits
arising from them for the support & maintenance of my daughter Mary Love
& her three daughters, Martha, Sarah, & Jane, & the support of my
daughter Elizabeth Ewell & the support & maintenance & education of her
serval children. At the death of my said daughters Mary Love & Elizabeth
Ewell, I desire one half of the above mentioned slaves equally divided
among the three daughters of my aforsaid daughter Mary Love or the
survivors of them & the remaining half sold & the money arising from the
sale be equally divided among all the several children of my said
daughter Elizabeth Ewell. In witness whereof I have hereunto set my hand
